Definitions of terms

In these Terms and Conditions of Use, the following terms shall have the meanings set out below:

2. Person responsible for the processing

The data collected are processed by the individual company Saleck Hamine Bouneggar registered under number 827 750 084 at the RCS of Bobigny, whose head office is located at 23 rue Marcello Mastroianni 93000 Bobigny, France. InReveal values your privacy and the protection of your personal data. This Privacy Policy is intended to inform you about how we treat the personal data you provide to us and that we collect in connection with your use of the Application and the Services. Please read this document carefully to understand our practices regarding the processing of your personal data and your rights in this regard. This Privacy Policy applies to all Services published by InReveal that you use (excluding services provided and operated by third parties, in which case the privacy policy of such third parties applies and not these provisions).

Application: the InReveal application, available on the Apple App Store and the Google Play Store.

InReveal: Saleck Hamine Bouneggar, self employed company registered at the RCS Bobigny under the number 827 750 084 and owner and sole operator of the Application and the brand InReveal.

CGU: the present General Terms of Use.

Member: person registered on the Application.

Member's characteristics: Information provided by the Member describing his/her profile in relation to his/her lifestyle and characteristics. The Member can select the information that he/she wishes to include on his/her profile and filter the other Members appearing on the Application according to this information.

Map: a map that allows you to find the cross-referenced members.

Pass (symbolized by a cross): action symbolized by a cross to express lack of interest. This action is secret and is not subject to any notification. The "Passed" profiles will no longer appear on the Member's News Feed in the future, but can still be found on the Map.

Profile photos: profile photos allowing easy recognition of the Member, constituting an essential condition for the use of the Services.

Services: all the services, paid or not, offered by INREVEAL to promote virtual or real meetings between Members who have crossed paths and are of mutual interest, according to the search criteria selected.

Account: personal space dedicated to the Member on the Application, which he/she accesses by registering and logging on to the Application. It allows the Member to access the Services. A Member may only have one Account.

Google, Apple, Facebook, Instagram Connect: a feature that allows Members to use their account to sign in to the Application to simplify the registration and login process.

Article 1: Scope of application

The GTC define the rights and obligations of the parties in the context of the use of the Application. They are the basis of a contractual relationship between the Member and INREVEAL.

Article 1: Scope of application

The present General Terms of Use (GTU) define the main rules for using the Application. They are supplemented by additional policies - the PolicyPrivacy, the Policy ’Cookie Usage- in order to guide the Member more precisely in the handling of the Application. In the event of a conflict between the different policies resulting in a lack of accessibility, intelligibility and/or predictability of the rules, the present TOS shall take precedence over the Privacy Policy, the Cookie Usage Charter and the Trust Charter.

1.2 Autonomy of stipulations

In the event that one of the stipulations of these GCU is declared null and void or inapplicable by the effect of a law, a regulation or a decision of a competent court, only this stipulation will be set aside while the other stipulations will retain their validity and force, except in the event that the present GCU are distorted or that this leads to a significant imbalance in the obligations of the parties.

Article 2: Modification of the GCU

2.1 Update

INREVEAL reserves the right, at any time and unilaterally, to complete or modify the present GTC in any way it deems necessary, or to terminate the Services. The Member shall be informed of the update of the GCU via the Application and/or by sending an e-mail to the address provided by the Member. It is the Member's responsibility to ensure that this e-mail address is valid. It is the Member's responsibility to read the TOS carefully when it is updated and to be fully aware of the changes it brings about. The fact that the Member continues to use the Services of the Application after the update of the GTC shall be deemed to be his unreserved acceptance of the modifications made to the GTC. In case of disagreement with the modifications of the TOS, the Member has the right to terminate the Services and to delete his/her Account in accordance with article 15.3.

2.2 Immediate application

Any new version of the TOS will be immediately applicable to Members.

Article 3: Applicable Law and Dispute Resolution

3.1 Applicable law

These GTC are subject to French substantive law, to the exclusion of all rules of conflict of laws.

3.2 Dispute Resolution

In the event of a dispute, the Member undertakes to contact INREVEAL directly in writing at contact@inreveal-app.com prior to any other judicial or extra-judicial action, in order to attempt to resolve the dispute amicably. In case of failure, the Member is informed that he/she can choose to have recourse to mediation free of charge and can submit any complaints on the dispute resolution platform put online by the European Commission at the following address: http://ec.europa.eu/consumers/odr/. Any dispute or litigation relating to the formation, interpretation, performance or termination of these Terms and Conditions or in connection with these Terms and Conditions that could not be resolved amicably shall be submitted to the competent courts of Paris (France).

Article 4: Registration

4.1 How to download the Application

The Application is available on the legal download platforms of Apple and Google INREVEAL accessible for free at this address https://inreveal-app.com It can be downloaded for free from the Apple App Store and Google Play Store, on iPhones running IOS version 10 or higher or Android smartphones running version 5 or higher.

4.2 Member's right to registration

When the necessary conditions for the status of Member are met, INREVEAL allocates to the Member, on a personal basis, an Account containing : - A profile sheet A Member may only have one Account.

4.3 Member's obligations upon registration

The Member must be at least 18 years old and guarantees that all the information he/she communicates during his/her registration is accurate and up-to-date. Registration is done via these alternative means: - Via Google, Apple, Facebook, and Instagram Connect: the Member can create a "profile" instead of creating a profile with an classic registration with an email and a password.   By registering, the Member agrees to these GTC and the Privacy Policy and undertakes to respect the obligations incumbent upon him/her, in particular those mentioned in the Member's Code of Conduct defined in Article 8 of these GTC.

Article 5: Services and features

5.1 Purpose of the Services

INREVEAL is an online dating application allowing the Member to find within the Application the people he/she has met around him/her or those he/she could meet, as well as those who are likely to interest him/her according to his/her search preferences, his/her profile activity or his/her Characteristics. The use of the Application is strictly limited to personal and leisure purposes.   Each Member is free to discuss and establish relationships with other Members in accordance with these TOS and the law.   In no case can the Services offered by INREVEAL be considered as marriage advice or brokerage. They only aim at facilitating the meeting through the Application according to the location and preferences of the Members, in a virtual or real way, between Members who are mutually interested.

5.2 Member Services

Some INREVEAL Services are available from the Application free of charge (excluding connection and telecommunication costs) for the Member who undertakes to comply with these GTC, namely - Viewing and browsing the Instagram, Snapchat, TikTok, Facebook, Twitter, Linktree profiles of other Members. - Skip a number of profiles. - Report in confidence all Members whose behavior is in violation of the TOS or applicable law. - Access the list of Members on the map - Access suggested profiles. - Set up your search preferences. Paid Services will be available in a later version and are not available at this time.

Article 6: Protection of personal data

INREVEAL attaches great importance to the protection of your personal data and respect for your privacy. We invite you to consult our Privacy Policy and our Trust Charter to find out how we handle your personal data, available by clicking on the Policy Privacy page

Article 7: Obligations and responsibility of INREVEAL

7.1 Technical and security resources

INREVEAL undertakes to provide the infrastructure and technical means required for the provision of a quality service to Members equipped with an iPhone terminal running the iOS 10 operating system or higher or an Android smartphone using version 5 or higher. INREVEAL shall not be held responsible for any malfunction of the Member's terminal or any compatibility problem between the Application and the terminal. In addition, all measures are taken to minimize the risk of fraudulent access to the INREVEAL system. In this respect, INREVEAL uses firewalls and equipment located between the Internet and a company's private network to increase the security of the latter by filtering traffic from or to the Internet. Nevertheless, it is impossible to guarantee the security of a network in an absolute way. INREVEAL is not responsible for any failure, interruption or malfunction of the Member's internet service provider, nor for any cause external to INREVEAL that may interrupt or damage access to INREVEAL Services. The Member must ensure that he/she has a secure e-mail address. In spite of or following the omission of these precautions, and although this probability is low, the Member's Account is likely to be a victim of fraud. INREVEAL also draws the Member's attention to any exceptional risk of receiving unwanted messages or messages purporting to come from INREVEAL. The Member must be attentive and vigilant in order not to be a victim of fraud and warns INREVEAL, if need be, by sending a letter or an e-mail to the address communicated in article 16.

7.2 Illegal behaviour

INREVEAL and its partners can in no way be held responsible, in any capacity whatsoever, for illegal actions liable to civil or criminal penalties, committed by its Members, including but not limited to:
- All types of scams
- All commercial or professional activities
- Prostitution
- Identity theft
- Infringement of any intellectual property rights of a third party
- Infringement of personality rights, such as the right to one's own image and the right to privacy.

7.3 Community reporting and moderation system

INREVEAL, as a host, is not bound by any legal obligation to monitor the content transmitted or stored via the Application under Article 6.I-7° of the Law for Confidence in the Digital Economy of 21 June 2004. However, Article 6.I-3° of this same law requires INREVEAL, as a host, to provide a notification system to report illegal, abusive and harmful content. In this case, after verification by the Customer Service, INREVEAL undertakes to promptly remove the said content. Under Article 6.I-5 of the LCEN: knowledge of a litigious content is presumed to be acquired when the host is notified of : - The date of the notification - The identity of the sender of this content - The description of the litigious facts (with the possibility of attaching screenshots of the litigious contents) - As well as the reasons why the content must be removed. INREVEAL has therefore equipped the Application with a community moderation system allowing Members to report content covered by Article 6.I-7 of the LCEN if they constitute, in particular, an apology for crimes against humanity, incitement to commit acts of terrorism and their apology, incitement to racial hatred, hatred towards people because of their sex, sexual orientation or identity or their handicap, as well as, in particular, child pornography, incitement to violence, incitement to violence against women, as well as offences against human dignity.   Guided by a particularly rigorous professional ethic in this respect and refusing to be associated with violent or insulting members as well as with illicit, abusive and prejudicial comments or content, the INREVEAL teams attach the utmost importance to this reporting procedure, which can also be implemented in the event of comments contrary to good manners. This is why, when the content published by a Member is the subject of such a report, the Member at the origin of the publication of this content is likely to have his or her Account suspended or even terminated, under the conditions provided for in article 15.4 hereof, on the basis of the evidence provided by the sender of the report, in order to ensure the removal of the contentious content in accordance with INREVEAL's legal obligations.   The Member whose published content is the subject of a report will not be informed of the identity of the Member who reported it.   Outside the framework of this reporting procedure, Members have the option of blocking another Member whose behaviour does not correspond to the rules of propriety in order to prevent any communication with him/her. This action is confidential and offers Members the possibility of controlling the Members with whom they wish to maintain contact or not. In the event of publication of content that has been the subject of a reporting procedure and is likely to be qualified as an offence under the legislative and regulatory provisions in force, the Member who is the victim of this content is also invited to refer the matter to the competent authorities. Indeed, the reporting procedure set up by INREVEAL does not replace a possible complaint and legal proceedings against the Member at the origin of the reported litigious content. Any abuse of the reporting system (unfounded reporting carried out in bad faith) shall also be considered a violation of these GTC and may lead to the suspension/termination of the Account of the Member having committed such abuse, in accordance with Article 15.4 of the GTC, in addition to the application of penal sanctions in accordance with Article 6.I-4 of the LCEN and legal proceedings giving rise to compensation for damages for the victims.

7.4 Rules of caution

The Member is solely responsible for verifying the identity of the persons with whom he/she could organize a "real" meeting. INREVEAL cannot be held responsible in case of any incident of any kind during a "real" meeting.

7.5 Group event

Any use of INREVEAL Services to organize a collective meeting of its Members constitutes a misuse of the Service. This is why it is formally forbidden to plan or organize an event on the public highway using the Application. If such a meeting takes place, INREVEAL cannot be held responsible for any public disorder or damage resulting from such meetings.

Article 8: Member's Code of Conduct

8.1 The obligation of loyalty and honesty in registration

In order to acquire the status of Member, it is necessary to meet all the following conditions: - Meet the conditions of majority as provided for by French law (be at least 18 years old). - At the same time, the Member undertakes to provide a valid e-mail address. - Undertake to regularly update the information provided by accessing his Account from the Application. - To have read and accepted the present Terms and Conditions of Use by validating his registration. INREVEAL has neither the legal obligation nor the technical means to verify the identity and age of Members. However, in the event of doubt, the presence of suspicious elements, or upon the denunciation of a third party via the "report" function, leading to the presumption of identity theft or the mention of fictitious or erroneous information, INREVEAL will carry out an investigation as soon as possible and may rectify, if necessary, the information communicated without altering the Member's profile. For the duration of the investigation, INREVEAL reserves the right to suspend the suspect Member's Account and access to the Application and to carry out the necessary verifications, in particular by requesting a copy of an official identity document. In the event that the Member is unable to provide said proof, or in the event of a proven violation of these GTC, INREVEAL may terminate the Member's Account in accordance with the conditions described in Article 15.4 hereof. The Member agrees to hold only one account. If the Member fails to do so, INREVEAL may terminate subsequent accounts, under the conditions described in Article 15.4.

8.2 Duty of honesty and fairness during use

In order to remain a Member, all of the following conditions must be met:
- Be honest and truthful in your statements.
- Only put online photos and/or profile information that allow easy recognition of the Member, and at least in the first position a Profile Photo as defined above, i.e. where your face is clearly recognizable, this constituting two fundamental criteria for the use of the Services, and excluding photos and/or information showing third parties or elements that have no link with the Member's person, so that INREVEAL reserves the right to delete at its discretion any photo and/or profile that does not meet these conditions.
- Do not post any confidential information about others, such as financial information.
- Not to publish on the Application pornographic content or photos that offend against human decency and dignity.
- To respect the privacy of the content and messages and voice messages exchanged with other Members within the Application and therefore not to disclose the content of these messages to third parties.
- Not to infringe on regulations relating to intellectual property and personality rights.
- Do not disturb the public order.
- Not to commit an offence of defamation and, more generally, not to make offensive comments, particularly of a racial or discriminatory nature.
- Respect the laws and regulations in force.
- Do not incite violence or racial hatred or glorify terrorism, war crimes or crimes against humanity.
- Do not violate the rules of propriety and remain correct with other Members.
- Not to interfere in any way whatsoever with the normal operation of the Services or the infrastructure of the Application.
- Not to modify, copy, assemble, decompile, or attempt to use the source codes, algorithms and software of the Application, as well as those of INREVEAL's partners, for any purpose other than those provided for in these terms and conditions, including but not limited to reverse engineering purposes.
- Do not use bots or tools other than those provided by INREVEAL within the Application when contacting others.
- Do not use the Application to arrange professional (escort or similar) services.
- Not to solicit other Members for the purpose of promoting paid products or services.
- Not to divulge to other Members his connection information, in particular the password and the identifier of his Account.
- Not to advertise or incite in any way to use any other service, competitor or not, and not to commit any act of unfair competition.
- Do not use the Application for the purpose of organizing rallies or demonstrations. The Member is also forbidden to make any copy and/or distribution and/or transfer of technical data that he/she would intercept on the network in connection with the INREVEAL Application.

8.3 Personal use

The Member agrees to use the Application only for personal purposes. The INREVEAL network must not be used for commercial, promotional, electoral or recruitment purposes. Sending messages for marketing and/or commercial purposes and/or newsletters via the Application's messaging system that include, in particular, but not exhaustively, content, indications or hyperlinks referring to sites or media of third-party companies, and in particular those competing with INREVEAL, is formally prohibited.

8.4 Member Responsibility

The Member is solely responsible for his actions and the data he publishes via the Application. If INREVEAL is held liable for the Member's failure to comply with his or her obligations, the Member guarantees INREVEAL against any judgement pronounced against him or her, arising from the Member's breach of the law or of these GTC. The Member may report illegal content, content that violates laws and regulations or these GTCs by means of the reporting tools provided by the Application in accordance with article 7.3 of these GTCs.

8.5 Photos

All photos of a pornographic, exhibitionist or indecent nature and generally contrary to morality are strictly prohibited. The publication of such photos constitutes a serious offence, which may result in the suspension and/or termination of the Member's Account, without prejudice to other sanctions that may be pronounced by the courts.

8.6 Actual encounters

INREVEAL warns Members who wish to conduct "real" meetings. It is entirely up to Members to verify the identity of the people with whom they organize these meetings. These "real" meetings are organized independently of INREVEAL, under the sole responsibility of the Members. INREVEAL cannot be held responsible for acts and incidents, of whatever nature, committed or caused by Members and/or former Members during events taking place following the use of the Application. In this respect, the INREVEAL messaging system voluntarily offers the advantage, again with the aim of preserving the peace and security of its Members, of allowing them to decide who will be authorised to see their profile and to chat with them. Concerning the persons with whom the Member has agreed to exchange Messages, it is strongly recommended not to reveal personal information that does not appear on the profile of the Application, such as telephone number, address or family name. INREVEAL strongly advises, as a security measure, to organize real meetings only in crowded public places or to inform a relative and not to reveal his or her contact information until after a reasonable time.

8.7 Maintenance of the Account

The Member should regularly check his or her email and notifications through which INREVEAL will keep him or her informed of, among other things, information relating to its Services and any changes and updates made. This information may also be sent by email to the Member's email address. The Member may access the Services of his or her Account by connecting to the Application using a confidential login and password. The Member is solely responsible for his or her connection information and must ensure that no third party can access it. In particular, the Member guarantees INREVEAL of any communication or use or statement made through his or her Account.

8.8 Equipment

The equipment (hardware or software) required to access the Services as well as all other related costs, including telecommunication costs, are the exclusive responsibility of the Member. The Member is solely responsible for the equipment used in the context of the Service.

Article 9: Communication with the Member

11.1 Newsletter

When registering on the Application, the Member receives a newsletter from INREVEAL. The Member may unsubscribe at any time by clicking on the "unsubscribe" link provided for this purpose in the newsletter and/or by exercising his right to object by sending an e-mail to the address communicated in article 16 of the GCU.

11.2 Advertising and Promotional Messages

INREVEAL is free to display, in the context of the execution of the contract and through the Application, advertising and/or promotional messages from advertisers and other partners.

Article 12: Sponsorship

12.1 Inviting friends

INREVEAL allows its Members to invite friends to join the Application in order to enlarge the network and increase their chances of provoking destiny. Sponsorship by a Member is limited to a restricted circle (relatives, friends) of the actual and physical knowledge of the sponsoring Member. Consequently, the massive recruitment of sponsored members outside this framework is strictly prohibited.

12.2 Benefits

INREVEAL reminds you that this optional feature offers simple advantages that are useful exclusively in the context of using the Application. INREVEAL in no way promises Members the right to any consideration in the form of direct financial gain.

Article 13: Intellectual Property

13.1 Copyright prerogatives

The original works offered by INREVEAL are the exclusive property of INREVEAL. INREVEAL is the owner of all related rights. Any representation and/or reproduction and/or distribution and/or exploitation of all or part of the content and services offered by the Application, such as software, animations, texts, photos, videos, graphics and, more generally, the general structure, by any process whatsoever, in any form whatsoever, on any medium whatsoever, is strictly prohibited without the prior express written consent of INREVEAL and may result in legal proceedings. These original works are protected by articles L.335-3 and following of the Intellectual Property Code currently in force in France and this, for the whole world.

13.2 License

The rights of use granted by INREVEAL to the Member are reserved for private and personal use. Any other use by the Member is forbidden without the express, written and prior authorization of INREVEAL. The Member grants INREVEAL and its partners a free, non-exclusive, worldwide and perpetual license to use, reproduce, represent, modify and translate any intellectual property element (texts, photos, videos, etc.) that he/she may provide to INREVEAL via the Application with the non-exclusive aim of supporting its communication efforts with other Members. This license will be used by INREVEAL within the limits of the respect of the right to image, the right to privacy, the protection of the user's personal data, without distorting the authenticity of the Member's profile and remaining consistent with his profile. This license authorizes INREVEAL to make these elements compatible with its technical performance or the formats of the media concerned. These rights are granted for the entire world for the entire duration of the execution of these GTC between the Member and INREVEAL. The Member remains the owner of the content and personal data he/she provides. The Member indemnifies INREVEAL against any legal action, recourse or sentence pronounced against it arising from the Member's violation of any intellectual property rights or personality rights of third parties. The Member indemnifies INREVEAL against all claims or damages such as, but not limited to, claims for compensation that may result.

Article 14: Counterfeiting, unfair competition and parasitism

It is strictly forbidden to design a product similar to the Application or to create a derivative thereof, and more generally to be guilty of parasitism, acts of imitation, denigration or any other act constituting unfair competition or acts of counterfeiting. If necessary, INREVEAL reserves the right to summon the Member to obtain full compensation for the damage caused by the Member. The Member may also be subject to severe legal penalties if he or she succeeds or attempts to license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to third parties the Services or the Application in any way.

Article 15: End of the contract

15.1 Deactivation of the Account by the Member

The Member may, at any time, deactivate his or her Account without notice via the Application if he or she no longer wishes to be visible on it. When deactivating the profile : - The Member's profile will be made invisible to other Members for the past and future. - There is no impact on the legal obligation to retain data. - In case of reactivation of the Account within a period of 1 year from the closing of the Account, the Member will find all of his or her stored data and the profile will become visible again.

15.2 Uninstallation of the Application by the Member

The Member may uninstall the Application from his or her mobile phone at any time without notice. Consequently, the Member will no longer be able to access the Application unless he/she downloads it again. - Uninstalling the Application does not delete the Member's account. It is therefore recommended that you delete your account from the Application before uninstalling it. - The deinstallation of the Application does not affect the legal obligation to retain data. - In case of re-downloading the Application within 1 year from the uninstallation of the Account, the retained data will be reassigned to its profile and the profile will become active again.

15.3 Deletion of the Account by the Member

The Member may decide to permanently delete his or her Account at any time and without prior notice, using one of the following alternatives:
- By deleting it itself from the Instagram App by going to Settings > Apps & Websites > InReveal -> Delete.
- By sending an e-mail or a letter to INREVEAL, whose postal address and e-mail address appear in article 16 of these terms and conditions. Consequently, the Member's profile will be permanently deleted.

15.4 Suspension / Termination of the Account by INREVEAL in case of breach of the GTC by a Member

In the event of a Member's failure to comply with the GTC, his or her Account may be suspended at any time as a precautionary measure and then terminated by INREVEAL as of right. INREVEAL may suspend the Member's Account for the time necessary for INREVEAL's customer service department to carry out checks following a report in accordance with article 7.3 hereof or in the event of an alleged breach of the GCU that can be remedied. The Member is invited to contact INREVEAL's customer service by e-mail in order to obtain further information on the reasons for the suspension of his account, to make any observations and/or to provide proof that the breach has been remedied.   If within 30 days of the notification of suspension of the Account, the Member has not contacted INREVEAL's customer service or if the elements provided by the Member to the customer service have not allowed the breach to be remedied, INREVEAL may notify the Member of the termination of his or her Account via the Application and/or by e-mail and inform the Member of the period during which he or she will not be able to re-register on the Application. If not specified, this period is set at 1 year from the notification of the termination of the Account. Upon termination of the Account: - The Member's profile will be made invisible to other Members. The Member will not be able to reopen an Account for a maximum period of 1 year from the notification of the termination of the Account.

15.5 Termination of inactive Accounts by INREVEAL

INREVEAL will proceed to delete inactive Accounts, as defined below. An Account is considered inactive if, for a continuous period of 1 year, the following two cumulative criteria are met:
- The Member's Application has not established contact with INREVEAL's servers (in particular due to the deactivation of the geolocation option) and ;
The Member has not used the Application. The Member shall be informed by e-mail, to the address he/she has given in the Application, of the deletion of his/her Account with a notice period of 8 days.
The Member may, at any time during the notice period, reactivate his or her Account, which will have the effect of suspending the termination procedure. The entire content of the profile will then be retained by the Member. At the end of this notice period, and in the absence of any response from the Member, the account will be automatically deleted by INREVEAL. When deleting the Account:
- The Member's profile will be made invisible to other Members.
- The Member's data will be kept for 1 year from this date, in particular with regard to the legal obligations incumbent on INREVEAL, in accordance with the methods set out in article 9 of the Confidentiality Policy, and then definitively deleted at the end of this period.
The Member will not be able to reactivate or request the reactivation of his old Account.

Article 17: Confidentiality clause

Neither INREVEAL nor the Member is authorized to disclose information about the contract between them in the event of a dispute and each party undertakes to respect a confidentiality clause which obliges it to prefer confidential negotiation in the event of a dispute.
